Contractual Terms and Conditions of the Services of sportovni-arealy.cz

I. Introduction
The provider of the Internet server sportovni-arealy.cz is Filip Lapeš, Okružní 386, 397 01 Písek, company reg. no.: 75309084 (referred to as “the Provider”) available at the Internet address (URL) http://www.sportovni-arealy.cz (referred to as “the Server”)

II. Description of the services of sportovni-arealy.cz
The Sportovni-arealy.cz Server contains an advertising space enabling users to see the offer of sports facilities with accommodation (referred to as “the Facilities”).
Sportovni-arealy.cz offers users the option to search through the offers of the Facilities registered on the Server. Users may search Facilities according to the region, city, district, type of accommodation (apartment, hotel etc.) and sports fields. Searching takes place on the basis of an agreement of the criteria selected by the user and the offer of the Facility.

III. Registration and editing Facilities on the sportovni-arealy.cz Server

1. Operators of sports facilities with accommodation (referred to as “the Operator”) can register every sports facility complying with the following requirements into the search facility at the Internet address (URL) http://www.sportovni-arealy.cz:
- The Facility really exists and its Operator is entitled to provide accommodation services pursuant to the rule of law of the Czech Republic and the Operator really provides such services at the given accommodation facility,
- The Facility has not been registered at sportovni-arealy.cz yet,
- If the Operator of the Facility runs more Facilities under one registration number, he or she can register such individual Facilities at sportovni-arealy.cz when these are different Facilities operating at different addresses, or when these are different Facilities (e.g. a hotel and a bed and breakfast within one object) operating at the same address.

2. The authorized Operator of the Facility proceeds in the following way in order to register within the sportovni-arealy.cz Server:
- He or she contacts the Server Provider by email requesting registration
- He or she fully accepts the contractual terms and conditions of the sportovni-arealy.cz Server.

3. The Operator of the Facility will be then contacted and sent a form for completion of data about the Facility and sports fields. On the basis of these data, the Provider will create an electronic presentation available within the presentation system of sportovni-arealy.cz or its partner systems at the Provider’s discretion, available to users on the Internet. The electronic presentation can also be created according to the data in the official promotion materials of the Operator of the Facility (www pages in particular). The Provider reserves 5 working days for the creation of the electronic presentation. The Provider reserves the right to check the data provided by the Operator and to subsequently mark the Facility as “verified”. The Operator is responsible for the data stated in the presentation.

4. The Provider will execute changes in the presentation of the Operator on the basis of a written requirement from the Operator.

IV. Price and Payment Terms

1. The Provider is entitled to remuneration according to the current pricelist for making the offer of the Operator according to this contract available. The Provider is entitled to change the pricelist unilaterally as of 1 January every year upon prior notification by email.

2. The agreed price of the fulfilment includes all costs of the Provider incurred in relation to the activities according to these contractual terms.

3. The Operator does not have to conclude a contract with the client on providing services mediated by the Provider. The Operator decides about the conclusion of the contract and the provision of services to the client.

4. The payments for the publication of the presentation will be executed on the basis of an issued call to pay in advance by the Provider with maturity of 14 days. When the payment is credited to the account of the Provider, the Provider will send a tax document about the received payment and the presentation will be published.

VI. Other Services

1. The Operator is entitled to purchase other advertising positions within the Server from the Provider. Information on advertising positions will be sent by email with an attached current pricelist at request.

VII. Other Provisions

1. The Operator of the Facility shall not, in any way, make the Provider responsible for any legal claims of third parties incurred on the basis of the publication of the data provided by the Operator of the Facility through the sportovni-arealy.cz Server.

2. The Provider reserves the right to refuse to publish any data if:
- they are or may be in contradiction to the rule of law of the Czech Republic,
- they are or may be in contradiction to good manners, or jeopardize public order,
- they are capable of causing damage to the Provider or third parties,
- their contents do not correspond with the interests of the Provider.

3. By accepting these terms and conditions, the Operator of the Facility expresses his or her consent being sent business messages by the Provider about other services or products that he provides as well as about the services or products of third parties.

4. In case of violation of these contractual terms, the Provider reserves the right to exclude the Operator and his or her accommodation facilities from the database of accommodation facilities on the Server according to the gravity for the period:
- until the situation has been rectified
- until the situation has been rectified and for the period of the following fortnight
- for an undetermined period.

5. The Provider reserves the right to change the Business Terms and Conditions for placing advertising messages at sportovni-arealy.cz and will provide their publication at the Internet address (URL): http://www.sportovni-arealy.cz.

6. The contractual relationship established between the Provider and Operator is subject to the Commercial Code, No. 513/1991 Coll., as amended.
These contractual terms become effective and valid on 1 September 2009.
